The vaccine war in court: Modern lawsuit, Pfizer strikes back

Laboratories Moderna and Pfizer are locked in a legal battle in which the former accused the latter of having “copied” its proprietary messenger RNA technology in the development of vaccines against Covid-19.

The central argument of Cambridge-based Moderna made clear that the company held patents from 2010 to 2016 on the technology of mRNA that made his vaccine possible spikevaxbut that the two competing companies copied said technology without any authorization to develop the vaccine commune.

In your demand, modern demanded an undisclosed amount of money damages for Pfizer Covid-19 vaccines sold starting in March.

Faced with this, Pfizer requested this Monday to a federal court in Boston that dismisses the claim in questionwhile a company spokesperson assured that the sued companies “they trust their intellectual property” and for this reason they will “vigorously defend themselves” against Moderna’s accusations.

The updated Pfizer vaccine more than 26,400 million dollars in the first nine months of 2022, according to company filings with the US Securities and Exchange Commission. At the other extreme, Moderna would have received more than 13,500 million dollars for the sale of vaccines during the same period.

Pfizer and BioNTech arguments

Pfizer and BioNTech argued in their favor that developed their vaccine “independently” and called Moderna’s lawsuit “revisionist history,” arguing that Moderna’s patents “far exceed its actual contributions to the field.”

The companies stated that Moderna ignored the contributions of its scientists to the fundamental technology of mRNAas well as those of researchers from the US government’s National Institutes of Health.

Ultimately, they highlighted that the lawsuit received is inadmissible since Moderna had promised not to sue other manufacturers of vaccines against Covid-19 during the pandemic, which remains active to this day.
